By accessing our website at www.hesperiaasphaltpaving.com, requesting a service estimate, or engaging Hesperia Asphalt Paving ("we," "us," or "our") to perform any work, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.
Hesperia Asphalt Paving provides asphalt paving, sealcoating, crack sealing, pothole repair, parking lot maintenance, grading, drainage work, and related contractor services in Hesperia, CA and surrounding areas.
The specific scope of work for each project is defined in a written estimate or contract provided before work begins. Services not listed in that written agreement are not included in the price and may be quoted separately.
All estimates provided by Hesperia Asphalt Paving are based on a site visit or information you provide. Estimates are valid for 30 days from the date issued unless otherwise stated. Final pricing may vary if actual site conditions differ materially from what was assessed at the time of the estimate.
We reserve the right to adjust pricing if material costs change significantly between the estimate date and the scheduled work date, or if the scope of work changes at your request.
Estimates do not include permit fees unless specifically noted. Permit fees, where required, are your responsibility unless we have agreed in writing to pull permits on your behalf as part of the project.
Once a project is scheduled, we will make reasonable efforts to complete the work on the agreed date. We may need to reschedule due to weather conditions, equipment availability, or other circumstances outside our control. We will notify you as early as possible when this occurs.
If you need to cancel or reschedule, please notify us at least 48 hours before the scheduled start date. Cancellations made with less than 48 hours notice may be subject to a fee to cover mobilization costs that were already incurred.
For projects where a deposit has been collected, cancellation policies will be specified in your written agreement. Deposits may be non-refundable if materials have already been ordered or crews have been scheduled.
Payment terms are specified in your written estimate or contract. For most residential projects, payment is due upon completion of the work unless a deposit arrangement has been agreed upon in writing.
Accepted payment methods will be stated in your project agreement. We reserve the right to require a deposit before scheduling work, particularly for larger projects or projects requiring special materials.
Accounts not paid by the due date stated in the written agreement may be subject to a late fee. If collection action becomes necessary, you agree to reimburse us for reasonable collection costs, including attorney fees where permitted by law.

We are not responsible for damage to unmarked underground utilities or features that were not disclosed before work began.
We stand behind our workmanship. Any warranty on materials or labor will be stated in your written project agreement. Where no specific warranty period is stated, our workmanship warranty covers defects in our labor for 90 days from the date of project completion, subject to the conditions below.

Asphalt is a flexible pavement material. Minor surface variations, slight color variation, and minor edge irregularities are inherent characteristics of asphalt and are not defects covered by warranty.
To the fullest extent permitted by applicable law, Hesperia Asphalt Paving's total liability for any claim arising out of or relating to our services shall not exceed the total amount you paid us for the specific project giving rise to the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, loss of use, or damage to property not directly caused by our work.
The content on our website is provided for general informational purposes. We make reasonable efforts to keep information current and accurate, but we do not warrant that all content is error-free or complete.
You may not use our website for any unlawful purpose, to transmit harmful content, or to attempt to gain unauthorized access to our systems. We reserve the right to terminate access for users who violate these conditions.

If informal resolution is not possible, disputes shall be resolved through binding arbitration under the rules of a mutually agreed arbitration provider, or - where arbitration is not agreed upon - in the courts of California, as described below.
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in the state or federal courts located in San Bernardino County, California.
We may update these Terms and Conditions at any time. Changes take effect when posted to this page. The effective date at the top of this page will be updated accordingly. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised terms.
